RELEASE OF LIABILITY
Welcome to Camp Orion, LLC, we hope that you will enjoy the hospitality for which Camp Orion (“COLLC”, Camp Orion Management LLC, and/or “Camp Orion”) is famous. We are delighted to have you join us, but before you visit, there is important business to which we must attend. Much of Camp Orion is native land, and as such can be as dangerous as any other natural area. Moreover, you or your dependents are here to enjoy activities that involve danger and depend on their good choices for good outcomes. You may be completely out of touch with anyone who can come to your aid in an emergency. When on Camp Orion, adults are responsible for their own safety and the safety of the minor children for whom they are responsible, even if the adults are not present. It is recommended that you carry a cell phone with you at all times and practice personal and gun safety that common sense dictates and as required under your valid hunting license.
As a condition precedent to visiting Camp Orion, you (the undersigned or dependent thereof) agree to, and hereby assume sole responsibility for your property damage, loss, bodily injury, or death occurring during, or in connection with, (a) your presence on Camp Orion, and/or (b) any item, service, facility or activity provided by, or any act or omission of, Camp Orion (and regardless of where provided or where occurring). By your signature below you hereby fully and finally WAIVE, RELEASE, and DISCHARGE and hold harmless COLLC, Camp Orion Management, LLC, its owners, officers, directors members, employees, and agents from and against any and all claims, injury action, loss, cost, expense, liability, penalty, charge or damage, including without limitation reasonable attorney fees and all costs and expenses of all actions, suits, proceedings, demands, assessments, claims and judgments, whether for injury or death to persons or damage to property, whether direct, pending, contingent or otherwise, that you or others on your behalf may have, arising out of, relating to, or resulting from your use of Camp Orion and its facilities WHETHER OR NOT CAUSED OR CONTRIBUTED TO BY THE NEGLIGENCE OR FAULT OF COLLC, ITS OFFICERS DIRECTORS, MEMBERS, EMPLOYEES AND/OR AGENTS.
By your signature below, you agree to indemnify, defend, and hold harmless Camp Orion, COLLC and all of its owners, officers, directors, members, employees, and agents from and against any claim, injury, action, loss, cost, expense, liability, penalty, charge or damage, including without limitation reasonable attorney fees and all costs and expenses of all actions, suits, proceedings, demands, assessments, claims and judgments, whether for injury or death to persons or damage to property, whether direct, pending, contingent or otherwise, threatened, suffered or incurred by Camp Orion and/or COLLC or any third party, including you and others on your behalf, arising out of, relating to, or resulting from your use of Camp Orion and its facilities WHETHER OR NOT CAUSED OR CONTRIBUTED TO BY THE NEGLIGENCE OR FAULT OF CAMP ORION, COLLC, ITS OFFICERS DIRECTORS, MEMBERS, EMPLOYEES AND/OR AGENTS.
By signing the below, you further agree to abide by all Camp Orion rules and Texas Parks & Wildlife hunting and fishing regulations in effect at the time of your visit. By your signing this agreement, this release and hold harmless shall also serve to similarly release any and all claims for liability against the foregoing released persons by such minor children or on their behalf for any claims that they may have, even if caused by the sole or joint negligence of the foregoing released persons.
